Terms and Conditions
Digital Courthouse -
Geoweb, LLC as "digitalcourthouse.com" is committed to excellence and providing all of its customers the best service possible. However, service and materials are provided by Geoweb, LLC on an "as is" basis and Geoweb, LLC expressly disclaims any and all warranties, express or implied, including without limitation warranties of merchantability and fitness for a particular purpose, with respect to the service or any materials and products. In no event shall Geoweb, LLC be liable for any direct, indirect, incidental, punitive, or consequential damages of any kind whatsoever with respect to the service, the materials and the products.
Customer Agreement -
Anyone who uses ("Customer") the Geoweb, LLC ("DCH") service agrees to abide by all terms and conditions set forth by DCH. Customer agrees to keep private their DCH username and password. Signing up for DCH service constitutes a contractual agreement and a request for
financial credit
by the Customer from DCH. The Customer is responsible for satisfying all charges incurred on the Customer's DCH account. Customer failure to pay for their DCH usage may result in Civil or Felony, Fraudulent Application for Credit charges. The Customer is responsible for canceling their DCH account. Non-use of DCH does not constitute an implied cancellation. Non-use of the Internet does not constitute an implied cancellation of your DCH account. Cancellation or termination of your Internet Service Provider (ISP), absence of an Internet connection, or a broken or otherwise non-working computer does not constitute an implied cancellation of your DCH account. In the event that a Customer supplied credit card does not satisfy a debt due to DCH, the Customer remains responsible for the amount due. DCH reserves the privilege to discontinue a Customer's service for non-payment. DCH reserves the privilege to assess a fee of US$20 to the Customer's DCH account where Customer's payment obligation is not met; bank draft returned to DCH as non-payable for any reason or credit card transaction is challenged

. DCH reserves the privilege to transfer any uncollected debts to a Collection Agency. DCH reserves the privilege to cancel any account engaged in
data mining
, extraction of DCH information with any automated device/software, unauthorized access of DCH data, or illegal activity. DCH reserves the privilege to cancel this agreement at any time. All accounts are non-refundable. Each username account is for ONE Customer ONLY, sharing or transferring user account information is not allowed. One Customer is considered to be a single person. Each user search is logged. Each user account and usage is audited. Any violation may result in Legal Action, Civil or Felony. Information from Geoweb, LLC's web sites or databases may not be shared with anyone. If a user name is shared within the same company then "Customer" is responsible for the number of people using the username. Each person using the username counts as one user. "Customer" is responsible for their username and password and financially responsible for
ALL
use and users of their username and password.
General Restrictions -
All databases available at DCH are purchased directly or indirectly from government agencies or other such subdivisions under various provisions of Freedom of Information and Public Access Laws. Some information has restrictions on its use and it is your responsibility to be informed about such restrictions. Usually, conducting research for your own or your business' use is regarded as acceptable but you should always check laws to verify for yourself. Most States in the United States require that you or your company be a licensed Investigator in order to collect or search for information on behalf of a client or anyone paying for such services.
Specific Database Usage Restrictions -
In addition to the aforementioned, some database providers require additional agreements to be entered into to gain access to certain specific databases. DCH provides a facility whereby the Customer may optionally
Deny
or
Accept
the additional
specific
Terms and Conditions as set forth by the controlling public record custodian and/or database provider. Acceptance of these
specific
agreements may, in some cases, place you into a contract with the
specific
public records custodian and/or database provider. DCH reserves the privilege to determine which
specific
database access may be properly available to a DCH account based on Customer supplied credentials and/or account profile information.
Policies and Positions
Customer privacy
Geoweb, LLC will
not
share, disclose, sell, or in any way provide any customer data to anyone. All customer data provided to Geoweb, LLC is considered
private
and
confidential
.
Position on Public Records
Geoweb, LLC's position on Public Records is as follows:
In that taxpayers enable government to collect information,
all
citizens should have access to
all
records and information generated by
all
levels of government
except
for (1) information related to the security of the State and (2) information related to ongoing criminal investigations. Geoweb, LLC reserves the right to deny access to anyone for any reason.
Position on database inaccuracies
Geoweb, LLC is a public records disseminator and is not responsible for any inaccuracies in any database. Geoweb, LLC will
not
modify records in any database upon notification of inaccuracies. Those wishing to have inaccurate data corrected must contact the reporting/supplying government agency and negotiate changes. Once changes are in place with the government agency, Geoweb, LLC will reflect the modification(s) in the regular update cycle of that database. In the event that Geoweb, LLC's regular update cycle is inconvenient, you may request that Geoweb, LLC update a database immediately. If Geoweb, LLC has available programmers and/or DBAs to accommodate the request, and the requester has agreed to pay for the update, Geoweb, LLC will try to satisfy the request(s) when deemed reasonable and/or possible.
