This End-User License Agreement ("Agreement") is a legal contract between you ("You" or the "Customer") and Digitalcourthouse.com, LLC "Digitalcourthouse.com"), which operates https://digitalcourthouse.com (the "Web Site"). By clicking the "Accept" button, or by downloading, installing, copying, or otherwise using the products or services provided on this website, You agree to be bound by the terms of this Agreement. If You do not agree to these terms, do not use the products or services provided on the Web Site in any way.

Payment. You agree to pay for the right to use the Web Site as defined in the User Access screen of the Web Site.

Limitations. You agree not to:

  1. Rent, lend, sell, or otherwise transfer this Agreement, Your use of the Web Site, or any material found on this web site;
  2. Reverse engineer, decompile, or disassemble any part of the Web Site or anything found on the Web Site;
  3. Copy or use any Content of the Web Site (Content of the Web Site includes all software and code used to operate the Web Site as well as all material present on and accessible through the Web Site), except as explicitly permitted by the Agreement;
  4. Prepare derivative works derived from any Content of the Web Site;
  5. Permit others to use the Web Site.

Proprietary Rights. All right, title, and interest in and to the Content of the Web Site are owned by Digitalcourthouse.com. Digitalcourthouse.com reserves all rights to copyrighted and copyrightable Content of the Web Site.

Disclaimer of Warranty and Limitation of Liability EXCEPT AS EXPRESSLY PROVIDED IN THIS AGREEMENT, THE WEB SITE IS PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND WITHOUT ANY WARRANTIES OF MERCHANTABILITY OR FITTNESS FOR ANY PARTICULAR PURPOSE. DIGITALCOURTHOUSE.COM does not warrant the performance of the Web Site or any results obtained using the web site. You assume the entire risk of using the web site. IN no event will Digitalcourthouse.com be liable for any consequential, incidental, or special damages arising in any way in connection with the web site.

Termination. Either party may terminate this license at any time. Digitalcourthouse.com reserves the right to stop offering services or supporting the Web Site at any time. In addition to any other remedies available at law, this Agreement will terminate immediately and without notice if You fail to comply with any terms and conditions of this Agreement. Upon termination of the Agreement, You agree to stop using the Web Site.

Customer Obligations and Digitalcourthouse.com Rights

You agree not to permit anyone to use your Web Site username or password.

This Agreement further constitutes a request for financial credit by the Customer from Digitalcourthouse.com. The Customer is responsible for satisfying all charges incurred on the Customer's Digitalcourthouse.com account. Failure of the Customer to pay its Digitalcourthouse.com account within 30 days of the date on which such billing is sent to Customer constitutes breach of this Agreement.

The Customer is responsible for canceling the Customer's Web Site account when the Customer desires to terminate this Agreement. Non-use of the Web Site does not constitute an implied cancellation, regardless of whether a third party is responsible for the non-use.

In the event that a Customer supplied credit card does not satisfy a debt due to Digitalcourthouse.com, the Customer remains responsible for the amount due.

Digitalcourthouse.com reserves the right to discontinue a Customer's service for non-payment.

Digitalcourthouse.com reserves the right to assess a fee of US$20 to the Customer's Digitalcourthouse.com account when the Customer's payment obligation is not met, including when Customer's bank draft is returned to Digitalcourthouse.com as non-payable for any reason or when Customer's credit card transaction is challenged (also known as a "charge back").

Digitalcourthouse.com reserves the right to transfer any uncollected debts to a Collection Agency.

Digitalcourthouse.com reserves the right to terminate this Agreement if You or anyone using Your account engages in data mining, extraction of Digitalcourthouse.com information with any automated device/software, unauthorized access of Digitalcourthouse.com data, or any illegal activity.

All amounts paid by You to Digitalcourthouse.com are non-refundable.

Each username account is for ONE Customer ONLY. You agree not to share or transfer Your user account information to anyone.

One Customer is considered to be a single person. Customer searches may be logged and Customer usage may be audited by Digitalcourthouse.com. 

You agree not to share information from the Web Site with anyone.If Your user name is shared within Your organization then You agree to pay for every user using the username, payment to be as required on the User Access screen of the Web Site at the time of use. Each person using the username counts as one user. You are responsible for Your username and password and financially responsible for ALL use and users of Your username and password. 

General Restrictions

Databases available on the Web Site may include information purchased by Digitalcourthouse.com directly or indirectly from government agencies or subdivisions.Certain information available on the Web Site may have government defined restrictions on its use and it is your responsibility to be informed about and to abide by such restrictions and to indemnify Digitalcourthouse.com for any improper use You make of the Web Site. (Usually, conducting research for your own or your business' use is regarded as acceptable but you should always check laws to verify that Your use is proper.)Various States in the United States require that you or your company be a licensed Investigator in order to collect or search for certain information available on the Web Site and, where applicable, You agree to meet all government requirements and indemnify Digitalcourthouse.com for any improper use You make of the Web Site.

Specific Database Usage Restrictions

In addition to the aforementioned, database providers ("Third Party Provider(s)") may require You to enter into additional agreements to be entered into to gain access to certain specific databases. Digitalcourthouse.com will endeavor to provide a facility whereby the Customer may optionally Deny or Accept the Third Party Provider's Terms and Conditions as set forth by the controlling public record custodian and/or database provider. Acceptance of these Third Party Provider agreements may form a legally binding contract directly between You and the Third Party Provider. Digitalcourthouse.com reserves the right to determine which Third Party Provider database access are made available to a Digitalcourthouse.com account based on Customer supplied credentials and/or account profile information.

Governing Law

This Agreement shall be governed by and interpreted according to the laws of the State of West Virginia and the laws of the United States of America, without regard to conflicts of law principles and the Parties agree to be subject to personal jurisdiction and venue in the state and federal courts of Fayette County, West Virginia in connection with any dispute over this Agreement.

Position on database inaccuracies

To the extent that Digitalcourthouse.com acts as a public records disseminator, Digitalcourthouse.com does not accept any responsibility for any inaccuracies in any database. Digitalcourthouse.com may not modify records in any database upon notification of inaccuracies. Those wishing to have inaccurate data corrected should contact the reporting/supplying government agency to request changes. Once changes are in place with the government agency, Digitalcourthouse.com, LLC will reflect the modification(s) in a regular update cycle of that database. In the event that Digitalcourthouse.com's regular update cycle is inconvenient, You may request that Digitalcourthouse.com update a database immediately. If Digitalcourthouse.com has available technicians able to accommodate such a request, and the requester has agreed to pay for the update, Digitalcourthouse.com will attempt to satisfy the request(s) when Digitalcourthouse.com deems it appropriate and reasonable.
